Agreement to these terms
These Terms & Conditions (“Terms”) govern your use of eclaimsbilling.com (the “Website”) and our text messaging program. The Website and program are operated by E Claims and Billing Services LLC (“eClaims Billing,” “we,” “us” or “our”), based in Durham, North Carolina.
By using the Website, submitting a form, or opting in to receive text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or our text messaging program.
The Website is intended for businesses and healthcare professionals in the United States. You must be at least 18 years old to use it.
Text messaging (SMS) terms
Program name: eClaims Billing Updates & Offers
Program description: when you opt in, E Claims and Billing Services LLC will send you recurring automated text messages. These include follow-ups about your inquiry, appointment reminders for consultation calls, service updates and occasional marketing messages about our services and free resources.
How to opt in: check the optional SMS consent box on our website contact form and submit the form with your mobile number. You can also text START or YES to our number. Consent to receive text messages is not a condition of purchasing any goods or services.
Message frequency: message frequency varies.
Cost: message and data rates may apply. Contact your wireless carrier for details about your text and data plan.
How to opt out: reply STOP to any message at any time. You can also reply UNSUBSCRIBE, CANCEL, END or QUIT. After you opt out, you will receive one message confirming that you have been unsubscribed, and you will receive no further text messages unless you opt in again. To opt in again, reply START or YES.
Help: reply HELP or INFO to any message for assistance, or contact us at +1 (800) 700-1210 or contactus@eclaimsbilling.com.
Carriers: wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier.
Your number: you confirm that you are the account holder or authorized user of the mobile number you provide. If you change or give up your mobile number, please reply STOP from that number first, or contact us.
No patient information: do not send patient names, dates of birth, insurance details or other health information by text message.
Privacy: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.
Use of the website
You agree to use the Website only for lawful purposes. You agree not to:
- Submit false, misleading or someone else’s information
- Interfere with the Website’s security or operation, or try to gain unauthorized access to it
- Use automated tools to copy, scrape or collect content from the Website without our written permission
- Use the Website to send spam or harmful code
Our services
The Website describes our billing and revenue cycle management services. Information on the Website, including pricing, results and performance targets, is for general information only and is not an offer or a guarantee. Results vary by practice. Any services we provide, including fees, performance targets and guarantees, are governed by a separate written agreement between eClaims Billing and the client. If that agreement conflicts with these Terms, the agreement controls.
No legal, medical or financial advice
Content on the Website, including articles, guides and audit information, is provided for general educational purposes. It is not legal, medical, compliance or financial advice. Payer rules and regulations change often, so please consult a qualified professional about your specific situation.
Patient health information
Do not submit protected health information (PHI) through the Website’s forms, chat, email or text messages. We receive PHI only from clients, and only after signing a Business Associate Agreement (BAA). Any PHI we handle for clients is governed by that BAA and by HIPAA, not by these Terms.
Intellectual property
The Website and its content, including text, graphics, logos and the eClaims Billing name, belong to E Claims and Billing Services LLC or its licensors and are protected by intellectual property laws. You may view and print pages for your own internal business use. You may not copy, modify, distribute or reuse the content without our written permission.
Third-party links and tools
The Website may link to or include content from third-party websites and tools, such as social media, scheduling or video services. We do not control them and are not responsible for their content or practices. Your use of them is subject to their own terms and privacy policies.
Disclaimer of warranties
The Website and text messaging program are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Website will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.
Limitation of liability
To the fullest extent permitted by law, E Claims and Billing Services LLC and its owners, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Website or text messaging program. Our total liability for any claim related to the Website or program will not exceed $100. This section does not limit liability under a separate written services agreement with a client.
Indemnification
You agree to indemnify and hold harmless E Claims and Billing Services LLC from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your misuse of the Website or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute related to these Terms will be resolved in the state or federal courts located in Durham County, North Carolina, and you consent to their jurisdiction.
Changes to these terms
We may update these Terms from time to time. When we do, we will post the new version on this page and update the effective date above. Your continued use of the Website or text messaging program after changes are posted means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Website and text messaging program.
